If Elliott's legal team can't put the suspension on hold again, he would miss the 49ers game, plus games against the Washington Redskins, Kansas City Chiefs, Atlanta Falcons, Philadelphia Eagles and Los Angeles Chargers. If granted, Elliott would be allowed to remain on the field. Should the court agree to hear the en banc hearing, it could potentially delay the suspension long enough for Elliott to play the full season. The U.S. Court of Appeals for the 2nd District famously rejected Tom Brady's petition for an en banc hearing pertaining to his Deflategate suspension past year. "The NFL believes that the latest order from Judge Mazzant simply keeps the case alive (but does not reinstate the injunction) pending a ruling from the Fifth Circuit on the question of whether the mandate to dismiss the case will be recalled, at the request of the NFLPA".

Last week the USA 5th Circuit Court of Appeals in New Orleans tossed NFL Player's association's claim that said Elliott did not get a fair hearing and lifted an order that blocked enforcement of the suspension.

"We are now exploring all of our legal options and will make a decision as to what is the best course of action in the next few days, " Elliott's attorney Frank Salzano said Thursday. Elliott has denied the allegations and was never criminally charged, but under the NFL's domestic violence policy, criminal charges aren't necessary to warrant a punishment. Elliott is not the first player the National Football League has suspended under its latest domestic violence policy, but he is the most renowned.
